UNHCR, the UN Refugee Agency, has submitted our observations to the Estonian government’s law proposal amending the Act on Granting International Protection to Aliens.
The aim of the proposal is to include the possibility to revoke refugee status and to allow an exception to the non-refoulement principle in cases when a refugee has been sentenced to prison for offences that classify the person as a danger to the community.
UNHCR would like to emphasize that the absolute prohibition of expulsion of a refugee prevails in cases when a refugee may risk being subject to torture and other cruel, inhumane, or degrading treatment or punishment – even in cases when the 1951 Refugee Convention otherwise allows for expulsion of a refugee who is considered a danger to the security of the host country.
