UNHCR’s Representation for the Nordic and Baltic Countries has submitted its observations on the Proposal for Law on Amendments to the Law on Temporary Residence Permits for Persons Displaced from Ukraine.
The Proposal seeks to amend the Law on Temporary Residence Permits for Persons Displaced from Ukraine (“Special Act”). The Special Act was adopted on 16 March 2022 following the full-scale invasion of Ukraine and forms the basis for granting refugees from Ukraine temporary protection in Denmark. Temporary residence permits under the Special Act were initially granted for two years until March 2024. In September 2023, the Government extended residence permits under the Special Act for one year until March 2025. The Proposal foresees the possibility to extend residence permits granted under the Special Act for one more year, until March 2026. At the same time, the Proposal seeks to suspend asylum processing for persons granted residence permits under the Special Act, until the basis for said permit ceases.
UNHCR welcomes the proposed extension of the granting of residence permits under the Special Act for one more year until March 2026. However, UNHCR is concerned that the proposed measures will lead to a differential treatment between holders of temporary residence permits under the Special Act and those granted temporary residence permits under the Aliens Act, in respect of the eligibility period for permanent residence permits.
